ELIGIBILITY RESTRICTIONS

NO PURCHASE NECESSARY.

  1. Eligibility:
    The Rustic Crust Share the Moment and Friends for Dollars Promotions (Promotions) are open only to legal residents of the 50 United States or District of Columbia who are 18 years of age or older at the time of entry. Employees of Rustic Crust and any of their respective affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee (whether or not related) are not eligible. By participating, entrants (and each entrant's parent/legal guardian if entrant is a minor in entrants jurisdiction of residence) agree to these Official Rules and the decisions of Rustic Crust and/or Administrator which are final and binding in all respects and in all matters relating to these Promotions. Void where prohibited.
  2. Promotions Period:
    The Promotions begins on June 8, 2009 at 12:00:01 a.m. Eastern Daylight Savings Time (“ET”), and ends on December 31, 2009 at 11:59:59 p.m. ET (“Promotions Period”). The Promotions computer is the official time-keeping device for the Promotions.
  3. To Participate:
    1. Online: To participate online access the Web site www.rusticcrust.com  (“Web Site”), navigate to the Entry Form page accessible through the text link and complete the required information. Then, follow the instructions to submit your Entry. Before submitting your Entry you will also be required to confirm that you have read and agree to these Official Rules. Entries must be received and recorded by the Promotions computer during the Promotions Period.
    2. Entry Requirements: Your entry (“Entry”) must be in English, and must contain:
      1. Your original recipe to prepare the pizza.
      2. Complete instructions/directions for preparation of the pizza, including but not limited to ingredient preparation, cooking temperatures, and types (but not brands) of products used.
      3. An original photograph or video taken by entrant of the cooked pizza. All pictures and videos submitted will become the property of Rustic Crust and will not be returned.
    3. Entries (and all elements of the Entries as above stated) must:
      1. contain, depict, and or reference the entrant's original recipe with all right, title and interest in and to the recipe, (and all elements of the Entries as above stated) including but not limited to any patent rights, trade secret rights, and/or copyrights owned exclusively by entrant,
      2. not have been submitted previously in a Promotions or competition of any kind or exhibited or displayed publicly or published through any means,
      3. not contain material that violates or infringes another's rights, including but not limited to copyright, patent, trade name/trademark, and/or rights of privacy or publicity, slander, libel, or portrayal in a false light,
      4. not disparage Rustic Crust, Administrator or any other person or party or any product or service, whether or not affiliated with the Promotions and administration of this Promotions,
      5. not feature brand names or trademarks other than Rustic Crust brand names or trademarks, which entrant has a limited, non-exclusive, non-transferable license to use for this Promotions,
      6. not contain text or any visual representation that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous,
      7. not contain text or visual representation that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age,
      8. not contain material that is unlawful, in violation of, or contrary to any laws or regulations, and,
      9. not contain any deleterious material such as but not limited to virus, bugs, or tracking or other embedded material or programs.

By submitting an Entry each entrant warrants and represents that his/her Entry (and all elements of the Entries as above stated) conforms to the above. Entries cannot contain, among other things, the trademark, trade name or logo of any third party or entity or product (including but not limited to the trademark, trade name or logo of any product competitive with any Rustic Crust product), cannot name, depict or describe any person (living, dead, or fictional) other than the Entrant, and cannot contain any material that is protected by copyright.

    1. Additional Entry Conditions: All Entries will become the exclusive property of Rustic Crust, and none will be acknowledged or returned. Once an Entry is submitted it cannot be changed, altered or modified. By entering, each Entrant grants permission for the use of his/her Entry (and any portion thereof), and his/her name, to be posted on the Internet and Web site or any web site in connection with this Promotions, and used in the advertising, Promotions, and publicity of the Promotions, and otherwise in connection with the Promotions as stated in these Official Rules (as solely determined by Rustic Crust); and each Entrant warrants and represents that he/she has all right and authority to grant such permission. Notwithstanding anything to the contrary, however, there is no obligation of the Rustic Crust or any other person or entity to post or make any use of the Entry of any particular entrant, or of any entrant.
    2. Entry Limits: Limit one Entry per entrant, email address or household.
  1. Winner Determination:
    1. Judging: Eligible Entries will be judged by a panel of judges determined by Rustic Crust. Entries will be judged on the following criteria: creativity of recipe; instructions/directions for recipe; visual appeal of the pizza ready to be served as depicted in photograph (the quality of photograph will not be taken into consideration and the description of the family or group experience. Decisions of the judges are final.
  2. Prizes:
    Prizes will be awarded in the form of a check or gift card as determined by Rustic Crust.  At the sole discretion of  Rustic Crust, Rustic Crust may, but shall be under no obligation to do so, publish any winner's Entry (or any portion thereof) in advertising and/or Promotional materials. Winners are solely responsible for all federal, state, and other taxes associated with prize receipt and/or use.
  1. General Conditions:
    By entering, entrants release and agree to indemnify and hold harmless Rustic Crust their respective affiliates, subsidiaries, advertising, public relations and Promotions agencies, Contest judges, and all of their respective officers, employees, directors, representatives and agents (individually and collectively “Releases”) from all liability, claims, actions, or proceedings, losses, injuries and damages(whether due to negligence or otherwise) to person(s), including death, and property damage, or the breach or failure of any representation or warranty, or obligation, or the violation of intellectual property or personal rights (such as but not limited to, copyright, patent, trade name/trademark infringement, and/or rights of privacy or publicity, slander, libel, or portrayal in a false light) due in whole or in part to acceptance, possession, misuse or use of the prize, or participation in this Promotions, or participation in any Promotions-related activity. By accepting the prize, each winner consents (and agrees to confirm that consent in writing upon request) to Rustic Crust and those acting pursuant to the authority of Rustic Crust, the right, in perpetuity, to the use of winner's name, voice, photo, picture, and likeness, and Entry (or any portion thereof), (and notwithstanding anything to the contrary in these Official Rules, licenses the use of the Entry which may be edited, modified, altered, changed, used alone, together or with other works, acts or content and/or used in composite form, with or without comment or commentary, all as solely determined by Rustic Crust) at any time or times in all media now known or hereafter discovered or devised, worldwide, including on the Internet and World Wide Web, for advertising, commercial, trade and Promotional purposes, without additional compensation unless prohibited by law, and without notice, review or approval. Each Potential Winner will be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release within 7 days after receipt of notification. If documents are not returned timely, or the prize notification or the prize is returned as non-deliverable, or if the potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize may be forfeited and awarded to an alternate winner. Each Entry will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner irrevocably sells, assigns and transfers to Rustic Crust all of winner's right, title and interest in and to winner's Entry, including but not limited to all copyright and trademark rights, (and waives all “moral rights” in favor of Rustic Crust) to Rustic Crust, which winner may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Upon request of Rustic Crust, winner shall execute and deliver such additional instrument of sale, transfer and assignment, and “moral rights waiver” as may be solely deemed by Rustic Crust, reasonably necessary to establish the ownership of record of the right, title and interest in and to the subject Entry and of the copyrights, and trademarks transferred, and the “moral rights waiver”. Should Rustic Crust fail to request the said additional instrument of sale, transfer and assignment and “moral rights waiver” as stated, that shall not be deemed a waiver of Rustic Crust’s rights and Rustic Crust may at a later time request that instrument, and the stated winner agrees to honor and comply with such request. Rustic Crust reserves the right not to award any prize if an insufficient number of qualified entries are received.
  2. Limitations of Liability:
    Releases are not responsible for lost, late, incomplete, stolen, misdirected, postage due, separated or illegible, mail, entries, or email; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/Web site/use net accessibility, availability, or traffic congestion, or any technical error, or any program or programming error or failure, or unauthorized human intervention, or the incorrect or inaccurate capture of registration, entry, or other information, or the failure to capture, or loss of, any such information. Releases are not responsible for any incorrect or inaccurate information, whether caused by Web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Promotions and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to, or use of, the Web site. Releases are not responsible for errors of any kind whether human, mechanical, electronic, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Entries, the announcement of the prize, winners or in any Contest-related materials. The right is reserved by Rustic Crust its sole discretion, to disqualify any individual found, at its sole discretion, to be tampering with the entry process or the operation of the Promotions or Web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or third party entry methods will void all such entries by such methods, and disqualify any participant using such methods. Releases are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotions or downloading or printing materials from the Web site or use of the Web site. If, for any reason, the Promotions are not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention fraud, technical failures, or any other causes which Rustic Crust, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of these Promotions, Rustic Crust reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotions and/or proceed with the Promotions in a manner deemed fair and appropriate by Rustic Crust. In case of dispute, the authorized subscriber of the email account used to enter the Promotions at the actual time of entry will be deemed to be the participant, and must comply with these Official Rules. The authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet Access Provider, on-line service provider, or other organization, which is responsible for assigning email addresses.
  3. Entrant's Personal Information:
    Information collected from entrant will not be used in any way by Rustic Crust or any of the associated companies for any purpose other than to communicate regarding the contest.
  1. Except where prohibited, entrants agree that:
    1. any and all disputes, claims, and causes of action arising out of or connected with these Promotions, or any prize awarded, or the determination of the winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and
    2. any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and
    3. under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
  • All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Releases in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New Hampshire without regard to conflicts of law doctrine of any jurisdiction, and all proceedings shall take place in the State of New Hampshire.
